WRONGFUL
DEATH LAWSUIT TO BE FILED IN SALVATION ARMY VAN CRASH
The
family of Jill Henry will file today at 2 p.m. a Wrongful
Death lawsuit against The Salvation Army, Inc. and The Salvation
Army Services, Inc. as a result of the tragic Jan. 26th
crash in Joliet, Illinois. Jill Henry, age 49, was killed
in the collision. Jill Henry lived at 11912 S. State St.
Chicago, IL.
Michael
Taylor, Ms. Henry’s son, will be appointed Special Administrator
of her Estate for the purposes of prosecuting the lawsuit.
Michael Henry lives at 2533 W. Oak St. Blue Island, IL..
The
four-count Complaint at Law alleges that the van’s driver,
Garneal T. Matthews was negligent in not properly controlling
the van on I55. Immediately following the filing of the
lawsuit, Kurt D. Lloyd and Timothy J. Cavanagh will file
an Emergency Motion for a Protective Order, seeking to have
all relevant evidence ordered to be preserved and not destroyed.
The
family's attorney, Kurt D. Lloyd and Timothy J. Cavanagh
of LLOYD & CAVANAGH, stated:
"This
was an absolutely tragic collision. The Salvation Army
driver was driving too fast for conditions. Had he been
driving at a speed that conditions allowed, this collision
would never have occurred."
LLOYD
& CAVANAGH currently represents the Velarde family in
its lawsuit against the Illinois Central Railroad Company
for the January 9, 2001 collision in Bloomingdale, Illinois
that was the subject of intense media attention. In the
last four months, LLOYD & CAVANAGH has settled two personal
injury cases for $13.5 million.
